Judicial Review – Challenging Unlawful Immigration Decisions
Judicial Review is a legal process used to challenge unlawful decisions made by the Home Office, courts, or other public bodies. Judicial Review does not reconsider the entire immigration application but instead examines whether the decision was lawful, fair, and reasonable.
Judicial Review may be used in cases involving:
- Visa refusals with no right of appeal
- Administrative Review refusals
- Unlawful detention
- Removal and deportation decisions
- Sponsor Licence revocation
- Long delays by the Home Office
- EU Settlement Scheme decisions
- Certification decisions
The Judicial Review process includes:
- Pre-Action Protocol letter
- Permission application to the Upper Tribunal or High Court
- Permission decision
- Substantive hearing if permission granted
Please note: We currently do not provide Judicial Review representation, but we may assist with Pre-Action Protocol letters and refer clients to specialist Judicial Review barristers where necessary.
