Administrative Review (Immigration Rules & Appendix EU)
Administrative Review is available where a visa application is refused and there is no right of appeal. This is common for:
- Skilled Worker visa refusals
- Student visa refusals
- Sponsor Licence decisions
- EU Settlement Scheme decisions under Appendix EU (No, administrative review is no longer available for new EUSS refusals. The right to request an administrative review was removed for EUSS applications decided on or after 5 October 2023. Any administrative review application submitted on or after 4 April 2024 will not be considered)
- Points-based system refusals
Administrative Review asks the Home Office to review the decision to determine whether a caseworker made an error in applying immigration rules or policy.
Strict deadlines apply, usually 14 or 28 days depending on the case.
